general terms and conditions of sales

This contract applies to the artist, further called seller, and person or institution, further called customer, purchasing from the seller a work of art, further called commission. by ordering from the seller, the customer agrees to the following terms and conditions.

General

  • The seller reserves the right to refuse any customer order for any reason.

  • The seller won't use the ordered artworks for commercial sales such as printing and selling products.

  • The seller reserves the right to post the commissions on their galleries, social media and as examples.

  • The customer agrees that the finished work will be delivered digitally to their given e-mail address or social media account. no physical version of the finished work is shipped.

  • Upon delivery of the commission, it's the customer's responsibility to store it properly. The seller cannot guarantee that the original file will be available again.

  • Once the customer confirmed an important pose, the seller can't change it. But the seller can adjust certain details like the ears, the tail. Once the seller have started shading, the seller can't change the details and won't accept any revision. The seller will accept three revisions before.

  • The seller needs to be able to contact the customer and get an answer within 1-2 days. Either on Instagram, Discord, or e-mail. If during the commission process the customer does not reply to the seller in the following month, the seller will cancel the commission, and the customer won’t get any refunds.

  • By placing an order, the customer ensures that he/she has the property rights to the character requested or that the character drawn for a gift has permission to be drawn and shared publicly.

  • The seller will only accept orders with clear references to the character or photos of pets.

  • During the commission process, the seller will frequently update the customer on when they will get the next update.

  • If the customer takes a long time to reply to the seller, it is not the fault of the seller if the commission takes longer than promised.

  • If the customer doesn't answer the seller within a month, the commission will be cancelled and the customer will not receive a refund.

  • Any disrespectful behaviour will not be tolerated. it may result in a cancellation without giving the customer a refund, and may result in the seller refusing any service to the customer in the future.

Payments

  • Payments are in EUR (Euros) or USD if the seller told it.

  • The customer agrees to pay the full amount of the commission up front (Paypal, Ko-Fi or Artistree)

  • Any other type of payment scheme must be mutually agreed upon in advance.

  • If the seller cancels a commission for any reason, the customer will be fully refund.

  • If the customer cancels the commission and already have confirmed a major pose, the customer will not be refunded.

  • The customer has the right to request a full refund if there's been no progress from the seller for two consecutive months.

Terms of use

  • Any use of the commission for commercial purposes, reselling it, reproduction or publishing for reasons other than personal use has to be approved beforehand with the seller.

  • The seller must always be credited to their social media in a visible way, unless discussed otherwise. The customer will receive the finished art with a signature. It is forbidden to erase this signature.

  • The seller must always be credited when the work is published on social networks or any other format.

  • The seller work may not be used to train Artificial Intelligence (AI) in any present or future projects in any capacity.

  • The seller work may not be minted/tokenized/sold as NFTs under any circumstance.

Adoptables

  • You can make changes in their design as long as they stay recognizable.

  • You can change the species.

  • You must credit me as the "designer" on any other website if you post them, but you can say the OC belong to you of course !

  • You can't resell them to a higher price if they haven't at least 1 more art piece attached to them.

  • Do not use my art commercially (example: make keychains or pins with my art and not yours).

  • Do not use my art to train AI.

  • Please be sure to be able to pay if you claim it. Don't claim if you can't afford it.

  • When buying me an adoptable, you agree with my Terms of service

  • I do not refund once the adoptable has been paid for.

  • Do not use my designs to make any illegal activity such as zoophilia or pedophilia.

  • If you break any of the rules, I may revoke your right to the adoptable.
